I've heard conflicting rumors about whether the trustees are meeting.
Here's what I (think) I can clarify:
* Clark Kellogg told me Wednesday they were planning to meet "in a couple of days."
* It appears the board has been given period progress reports by the 6-person panel (which includes three trustees). This was spelled out as one of their requirements in the original press release on Aug. 5.
* Based on my reading of the ORC open meeting requirements, any official action taken by the board or any meeting involving a "majority" of members would require a public announcement 24 hours in advance (other than an emergency meeting). Even for executive session, this must be made public.
* This means that officially speaking, the ball is in Drake's court with input from (select members of the) board since there have been no such public announcements.
* It also means that theoretically, these progress reports could happen with a handful of trustees, Drake and the panel.
So based on these things, Drake has the final call (officially) and any rumor of the board meeting today is not entirely accurate. Some members of the board may be getting briefed if the final report is prepared. Drake would be allowed in the discussion.
When I say Drake has the final call, I'm again only speaking technically, not practically. I have no disagreement that certain members of the board will likely have their 'say' ha ha.
